State Data Sharing Agreements

The Texas Education Agency operates the Texas Student Data System, a national platform for collecting, managing, sharing, and reporting state education data. The system has a dashboard that provides teachers with timely and achievable information and metrics of student performance. The system has guidelines on data standards and data governance. It also offers training and case studies to support the adoption of best practices. A unique identifier is assigned to users to protect the privacy of students and teachers before being publicly published in the Texas P-20 Public Education Information Resource, the state`s longitudinal data system, which shares and reports on trends and outcomes of students from kindergarten to college. Data sharing agreements must include provisions on access and dissemination. It is not desirable to enter into a data-sharing agreement to disclose data protection information, as non-federal organizations are not subject to data protection law. Similarly, it is worth drawing the attention of the non-federal organization to the fact that federal authorities may be forced to disclose information under the FOIA. This webinar, organized by the Center for Regional Economic Competitiveness and the National Governors Association, highlights the efforts of administrative teams from Iowa, Minnesota, South Carolina, Wisconsin and Utah to increase transparency on legal and regulatory barriers to the exchange of administrative data and to drive possible policy changes that would allow better access to administrative data. without infringing on their privacy and confidentiality. SDS leaders will share their experiences in building effective data governance structures, engaging stakeholders and building coalitions with multiple agencies, and navigating the legislative process. Data exchange also promotes accountability and transparency, allowing researchers to validate the results of the other.

They allow researchers to access data collected by public or local education authorities to study trends, determine the effectiveness of interventions, and assist agencies in their efforts to use research-based knowledge in decision-making. When a public health practitioner entrusts a project to their lawyer for the first time in order to assist with a data sharing agreement, it would be helpful to be prepared with factual information that will help the lawyer identify the needs of the Ministry of Health and identify the legal areas that might be affected by the proposed data exchange initiative. The Public Health Law Network proposes that the checklist of information needed to deal with the proposed data collection, access and transfer of data be made available to the public health prosecutor. This tool can also be useful in determining the data exchange objectives for the project and identifying potential data exchange partners. Examples of data exchange agreements used by public health authorities are as follows: microdata contained in administrative records contain personal data (PII), the implementation of security measures for the protection of disclosed data is a critical element of data exchange agreements. Some common protective measures are as follows: if the partner is a foreign company that does not accept compliance with U.S. law, the agreements must go through the USGS Office of International Programs. The transfer of administrative data from one agency to another is facilitated by the conclusion of formal data-sharing agreements….
